An off-duty police officer was travelling to work along Punt Road on Saturday 7 January about 11am when he observed the car travelling next to him carrying an overload of passengers.
The car had two adult passengers seated in the front of the car and three in the back.
The rear passenger seated behind the driver had a young child seated on their lap who did not have a seat belt on and was not in an approved child seat.
The officer from Prahran Highway Patrol noted the registration of the vehicle and made further enquiries upon arriving at work.
Further checks revealed the driver of the car was an Uber driver and he was on an Uber trip at the time of the incident.
The driver of the Uber, a 33-year-old Elsternwick man, attended the Prahran Police Station and was interviewed in relation to the incident the following day.
He is expected to be charged on summons for having an unrestrained child in the vehicle.
The driver also had his car impounded for 30 days.
