Protocol to improve investigation of abuse in disability services

Victoria Police and the Disability Services Commissioner (DSC) have released a landmark Protocol to improve the investigation of abuse of people receiving disability services.

    The Protocol is designed to improve the management of criminal and non-criminal investigations through increased information sharing, communication and referrals.

    The 2015 Parliamentary Inquiry into Abuse in Disability Services made a suite of recommendations aimed at addressing issues of abuse, neglect and violence within the system – including the establishment of protocols between Victoria Police and DSC.

    Acting Commander Tony Silva from the Victoria Police Priority Communities Division said a lot of work had been done to break down barriers and strengthen processes between agencies.

    “This is an important step that will help to ensure that people receiving disability services have the same access to justice as other members of the community,” A/Cmdr Silva.

    “Sometimes a matter or complaint will not meet the criteria of a criminal investigation, but there is still important information that needs to be shared to help improve the safety of vulnerable people.

    “Information that police may not have been allowed to share previously will now be exchanged with DSC to ensure that people receiving disability services have their concerns heard.

    “Similarly, criminality that has been alleged during a DSC investigation will be formally passed onto police through formal channels and processes.

    “It’s about keeping vulnerable people safe and ensuring the appropriate support services are provided and working together. It’s also about identifying the perpetrators responsible for any abuse, neglect or violence.”

    Mr Laurie Harkin AM, Disability Services Commissioner, said: “People with disability have the right to access the justice system. Their safety and wellbeing is paramount.

    “This protocol clarifies the roles of DSC and Victoria Police in conducting investigations into allegations of abuse or neglect in disability services and will help to improve organisational responses to better support the needs of people with disability.”
